PREMISES LIABILITY
Premises liability is defined as a category of law which addresses the duty an owner or manager business or property owes to customers, visitors or guests on the property.
Property Owners and managers have a duty to be sure that their properties are safe for both guests and trespassers. If owners or managers fail to maintain safe property conditions, or forewarn guests and trespassers of existing hazardous conditions, they can be held liable for any injuries that are incurred while on the owners’ or managers’ property.
In premises liability cases the owner or manager is generally regarded as the negligent party, and is therefore open to legal action. When a guest or trespasser is injured on an owners’ or managers’ property, they may seek monetary damages from the owner or manager.
