We recommend hiring the best business debt settlement companies in Los Angeles who have California-licensed counsel that can litigate the case. Such counsel should meet the deadlines to vacate a domesticated New York judgment and to exempt funds in the bank, and should negotiate settlements that remove title liens and bank levies along with the balance due.
Most companies ranked online in Los Angeles will not enroll your merchant cash advance because they work only with consumers. So, instead of a ranking, here is what to look for in a provider based on how enforcement works in Los Angeles County.
Where will the funder sue you in Los Angeles County?
If the funder sues you where you live, it will probably file in Los Angeles County Superior Court. Civil cases of $35,000 or less are limited under CCP 85, while those for more than $35,000 are unlimited. Limited cases are split into collections and non-collections by the civil division of the Los Angeles Superior Court, with the Stanley Mosk Courthouse downtown as a principal filing location.
If your contract points to New York, the funder may sue you there, domesticate the judgment in California as a sister-state judgment under CCP 1710.40 and then enforce it here. If so, you have 30 days from the service on you of the notice of entry of the sister-state judgment to file a motion to vacate it. Funders can no longer enforce a confessed judgment in any California superior court, pursuant to CCP 1132. Read more about this in our guide to the Best Business Debt Settlement Companies in California. For the New York City courts where funders file, see our guide to the Best Business Debt Settlement Companies in New York City.
How quickly can the Los Angeles County Sheriff seize your money in the bank?
With a California judgment and a writ of execution, the funder can hire the Los Angeles County Sheriff to seize your funds. They are frozen the same day the Sheriff personally serves the writ on the bank, and the bank must then send the funds to the Sheriff within 15 days. The Sheriff's requirements call for the original writ, 3 copies, branch instructions and a $50 fee deposit. The Sheriff has 16 civil branch offices, from Van Nuys to Long Beach.
The levy only reaches funds on deposit at the time of service, including uncollected deposits, under CCP 700.140. So, funders serve again once more funds are deposited. As of July 1, 2026, you are entitled to an automatic exemption of $2,325 for each judgment debtor under CCP 704.220. This should protect you as a guarantor, but probably not an LLC's account. Beyond that, you have 15 days from personal service of the notice of levy on you (or 20 days from its mailing) to file a claim of exemption, pursuant to CCP 703.520, which was amended by AB 774.
Can the funder force the sale of your home in Los Angeles County?
The funder can lien your home in Los Angeles County, but it cannot force the sale of your home unless it obtains a court order. The sale of a natural person's dwelling must also cover the homestead exemption plus all other liens. The homestead exemption under CCP 704.730 is the greater of $300,000 or the median sale price of single-family homes in the county in the prior year, under a cap that started at $600,000 and goes up every January 1st according to the California Consumer Price Index. The Los Angeles County median was $946,950 in August 2026, according to the California Association of Realtors. So, an owner who lives in the home should get the full capped amount.
A home in Van Nuys worth $950,000, with a $500,000 mortgage, requires a bid in excess of the homestead exemption plus the mortgage under Code of Civil Procedure section 704.800. If no such bid is received, the home will not be sold, and the creditor must wait a year to try again. The bigger problem is the abstract of judgment: once recorded with the Los Angeles County Recorder's Office, it remains a lien against the home for ten years from entry of the judgment (CCP 697.310), and any refinance or sale will be subject to it.
What should I look for in a Los Angeles business debt settlement company?
Can they work through each checkpoint above? Only a California-licensed attorney can represent you in Los Angeles Superior Court. Before hiring, ask:
- Who will file a motion to vacate or a claim of exemption, if one is necessary, within 30 days or 15 days of service?
- How fast will they respond to a Sheriff's levy, given the bank's 15-day deadline to send the funds?
- If payments to the funders cease so a settlement fund can grow, who represents you once a judgment and levy follow?
- Will your settlements include a filed satisfaction of judgment, a release of any abstract of judgment recorded with the Los Angeles County Registrar-Recorder's office, a release of Sheriff's levies and a UCC-3 termination?
- Does the company negotiate merchant cash advances and guaranty debt?
Don't be fooled by a "DFPI registered" badge. California's debt settlement registration covers only those helping consumers settle consumer debt. Likewise, the federal ban on collecting fees before a settlement applies only to consumer debt, so a business debt settlement company can charge fees before it settles anything.
Frequently Asked Questions
Can a merchant cash advance funder sell my house in Los Angeles?
Generally, no. A judgment creditor needs a court order, and the house will not be sold unless the bid exceeds the homestead exemption plus liens such as the mortgage. A recorded abstract of judgment can still remain on title for ten years.
How much money can I have in my bank account without having it levied by the Sheriff?
As of July 1, 2026, $2,325 per judgment debtor in a deposit account is automatically exempt without the need to file a claim of exemption.
I was sued in New York. Can the funder levy in Los Angeles?
Yes. The funder can have the New York judgment entered in Los Angeles Superior Court and levied by the Sheriff. You have 30 days after service of the notice of entry to move to vacate it.
If a company is registered to do debt settlements in California, can they negotiate my merchant cash advance?
Not necessarily. As of February 15, 2025, companies must be registered to negotiate consumer non-mortgage debt, and attorneys are not required to be registered. A registered company may be unable to negotiate merchant cash advances or personal guaranty debt, or to represent you in court.
